1. Parties
These Terms and Conditions (“Ts & Cs”) govern all services provided by Mau Decor and Mau Drinks (collectively referred to as “the Company” or “Mau”) to any client (“the Client”). By accepting a quotation, paying any amount, or confirming a booking, the Client agrees that these Ts & Cs constitute a binding legal agreement.
2. Scope of Services
Mau Decor provides event décor, styling, setup, hire, and breakdown services. Mau Drinks provides beverage-related services including bar setup, drinks provision, staffing (where applicable), and associated equipment hire. All services are subject to the details outlined in the approved quotation.
3. Quotations and Booking Confirmation
3.1 All quotations are valid for twenty-one (21) working days from the date of issue, unless otherwise stated in writing.
3.2 Prices, availability, and services are subject to change should the quotation expire.
3.3 A booking is only secured once the quotation has been accepted in writing and the required deposit has been received.
3.4 Mau reserves the right to cancel or refuse any booking should these Ts & Cs not be complied with.
4. Deposits
4.1 A non-refundable deposit of fifty percent (50%) of the total invoice value is required to secure the event date and day.
4.2 No date will be reserved without receipt of the required deposit.
5. Payment Terms
5.1 Full payment of the total invoice amount must be made no later than fourteen (14) working days prior to the event date, unless otherwise agreed to in writing by Mau.
5.2 Failure to make full payment within the stipulated time may result in cancellation of the booking and forfeiture of the deposit.
5.3 All payments are to be made in South African Rand (ZAR).
5.4 Payments must be made strictly into the bank account details as reflected on the official Mau quotation or invoice. Mau shall not be held liable for any payments made to incorrect or unauthorised accounts.
5.5 Cash deposits will attract an additional ten percent (10%) charge to cover banking and handling fees.
6. Breakage Deposit
6.1 A refundable breakage deposit equal to fifteen percent (15%) of the total invoice value is required for all events unless otherwise agreed in writing.
6.2 The breakage deposit covers theft, loss, damage, or excessive soiling of décor items, equipment, furniture, glassware, or any other assets supplied by Mau.
6.3 All items will be inspected after the event.
6.4 The breakage deposit, less any deductions, will be refunded within seven (7) to ten (10) working days after the event.
6.5 Should damages or losses exceed the breakage deposit, the Client remains liable for the full outstanding balance.
7. Event Notice Period
7.1 A minimum of twenty-one (21) working days’ notice is required for all events.
7.2 Events confirmed within less than twenty-one (21) working days of the event date will incur an additional surcharge of twenty percent (20%) of the total invoice value.
8. Cancellations
8.1 Any event cancelled within fourteen (14) working days of the event date will result in forfeiture of the deposit paid.
8.2 All cancellations must be communicated in writing.
9. Special Cancellation Considerations for Large Events
9.1 For events with a total invoice value exceeding R100,000, short-notice cancellations may be considered only in cases of:
– Death of an immediate family member (as recognised under South African law);
– Immediate and extreme health-related emergencies, supported by sufficient written proof
9.2 All such requests will be reviewed on a case-by-case basis at the sole discretion of the Director(s) of Mau.
9.3 Approval of such a request does not guarantee a refund and may be subject to costs already incurred.
10. Client Responsibilities
10.1 The Client is responsible for the safekeeping and appropriate use of all items supplied by Mau.
10.2 The Client accepts liability for any damage, loss, or theft caused by guests, venue staff, service providers, or any third party present at the event.
10.3 The Client must ensure adequate access, electricity (where required), and a secure environment for setup and breakdown.
11. Limitation of Liability
11.1 Mau shall not be held liable for any theft, death, loss, injury, or damage suffered by the Client, guests, staff, or third parties during or in connection with the event.
11.2 Mau shall not be liable for any indirect, incidental, or consequential damages.
11.3 Liability, where applicable, is limited to the value of the services provided.
12. Indemnity
12.1 The Client hereby indemnifies and holds Mau Decor and Mau Drinks, its directors, employees, and contractors harmless against any claims, damages, losses, liabilities, or expenses arising from the event, including claims brought by third parties, guests, venues, or suppliers.
13. Weather, Venue Restrictions, and External Conditions
13.1 Outdoor events proceed at the Client’s risk.
13.2 Mau shall not be held responsible for weather conditions, load shedding, venue restrictions, or acts beyond its contrthat may affect setup, service delivery, or the condition of hired items.
13.3 No refunds will be granted due to weather-related disruptions or venue-imposed limitations.
14. AlcohResponsibility (Mau Drinks)
14.1 Mau Drinks operates in accordance with applicable South African liquor legislation.
14.2 Mau Drinks reserves the right to refuse service to intoxicated persons or minors.
14.3 The Client accepts full responsibility for the behaviour, actions, and safety of guests consuming alcohat the event.
14.4 Mau Drinks shall not be liable for any incidents, injuries, or damages arising from alcohconsumption.
15. Changes, Substitutions, and Add-ons
15.1 Any changes or additions to confirmed bookings must be requested in writing.
15.2 Mau reserves the right to decline last-minute changes or apply additional charges.
15.3 Where specific items are unavailable, Mau may substitute with items of equal or greater value.
16. Photography and Marketing
16.1 Mau reserves the right to photograph or record events for marketing and promotional purposes.
16.2 The Client may opt out of such use by providing written notice prior to the event.
17. Force Majeure
Mau shall not be liable for failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to acts of God, extreme weather, power failures, strikes, or government regulations.
13. Governing Law
These Ts & Cs are governed by the laws of the Republic of South Africa, including the Consumer Protection Act (CPA), where applicable.
14. Amendments
Mau reserves the right to amend these Ts & Cs from time to time. The version applicable will be the one in force at the time of booking confirmation.
15. Acceptance
Acceptance of a quotation, invoice, or payment of any amount constitutes full and unconditional acceptance of these Terms and Conditions
